Terms of Service

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signature.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require the publishing of the rules and regulations, privacy policy, and Terms of Service for access to or usage of the domain name ziyaclothing.in (the "Website"), including any related mobile site and mobile application (together, the "Platform").

The Platform is owned and operated by ZIYA CLOTHING, a partnership firm having its registered office and principal place of business at 239-4,5,6,7, Kandhasamy Nagar, Sathy Road, Saravanampatti, Coimbatore, Tamil Nadu 641035, holding GSTIN 33AAEFZ4869N1ZE, and trading under the name Ziya Clothing (the "Platform Owner", "we", "us", "our"). In these Terms of Service, "you", "your", and "user" mean any natural or legal person who accesses, browses, or transacts on the Platform.

Accessing, browsing, or otherwise using the Platform indicates your agreement to all of these Terms of Service, together with our Privacy Policy, Returns & Exchange policy, Refund & Cancellation policy, and Shipping Policy, each of which is incorporated here by reference. Please read them before you proceed. We may modify these terms at any time; the effective date above reflects the current version, and it is your responsibility to review them periodically.

Any term or condition you propose that adds to or conflicts with these Terms of Service is expressly rejected and has no force or effect unless we have agreed to it in writing.

You agree to give us true, accurate, and complete information when you order, and you are responsible for everything done through your registered account — including the one-time password sent to your mobile number. By placing an order you confirm that you are legally able to make the purchase, and you agree to pay the charges shown for it.

Your order is an offer to buy, and it is confirmed once your payment is received — we sell online on a prepaid basis only, and cash on delivery is not offered. We may decline or cancel an order ourselves in cases of stock unavailability, an obvious pricing or listing error, or suspected misuse; if we do, the full amount you have paid is refunded to your original payment method.

You understand that on initiating a transaction on the Platform you are entering into a legally binding and enforceable contract with the Platform Owner for the purchase of the goods you have selected.

You may cancel an order at any time before it is dispatched. Call or WhatsApp our store number, or email us — all are listed below — with your order number, and we will cancel it and refund the full amount you paid. Once an order has been dispatched it can no longer be cancelled, amended, or redirected, so please check your size, quantity, and delivery address carefully before you pay. Refund methods and timelines are set out in our Refund & Cancellation policy.

All prices are in Indian Rupees and include applicable GST. A GST tax invoice is issued with every order. While we take care to keep prices and product details accurate, if a clear error is found in a price you have paid, we will contact you with the option of paying the correct price or cancelling for a full refund.

Online payments are accepted by UPI, credit card, debit card, and net banking, and are processed by a PCI-DSS compliant payment gateway; we never store your card or banking details on our servers. Every website order is prepaid — cash on delivery is not available. At our store you may pay by cash, card, or UPI.

Our garments are photographed as accurately as possible, but colours can vary slightly between screens and fabric, and handcrafted prints or weaves may show minor variations — these are characteristics of the garment, not defects. Size guidance is provided on each product page. Beyond this, we give no warranty as to the accuracy, completeness, or suitability of the information and materials on the Platform for any particular purpose, and you acknowledge that such information may contain inaccuracies or errors.

Your use of the Platform is at your own discretion, and you are responsible for independently assessing that a garment meets your requirements before you order — which is what the size guidance, the product photography, and our free video call are there to help you do.

Once delivered, website orders are not eligible for return or exchange on grounds of size, fit, colour preference, or change of mind — which is why cancellation stays open right up to dispatch. An item that reaches you damaged, defective, or different from what you ordered is always covered; this is set out in our Returns & Exchange policy, which together with our Shipping Policy and our Refund & Cancellation policy forms part of these terms. Nothing in these terms limits the rights available to you under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

All content on this Platform — images, text, design, layout, graphics, and branding — is proprietary to us or licensed to us, and you acquire no right, title, or interest in it. You may not copy, reproduce, scrape, or reuse it commercially without our written permission, and you agree not to use the Platform for any purpose that is unlawful or forbidden by these terms or by applicable Indian law. Unauthorised use of the Platform may lead to action against you under these terms or under law.

The Platform may contain links to third-party websites, including our payment gateway and courier partners. When you follow such a link you are governed by that third party's own terms and privacy policy, not ours; the links are provided for your convenience and we are not responsible for those sites.

You agree to indemnify and hold harmless the Platform Owner, its partners, and their respective officers, employees, and agents from any claim, demand, or action, including reasonable legal fees, arising out of your breach of these terms or of any of our policies, or your violation of any law or of the rights of a third party.

To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order, and we will not be liable for any indirect, consequential, incidental, special, or punitive loss, including loss of profits, business, data, or opportunity, however it arises. Neither party is liable for a failure or delay in performing its obligations caused by an event beyond its reasonable control, including natural events, strikes, civil disruption, courier or network failure, or governmental action.

Complaints are acknowledged within 48 hours and resolved within one month, as required by the Consumer Protection (E-Commerce) Rules, 2020. These terms, and any dispute or claim relating to them or their enforceability, are governed by and construed in accordance with the laws of India, and the courts at Coimbatore, Tamil Nadu have exclusive jurisdiction.
